Please read these Terms and Conditions carefully before using the Souk Realty platform. These Terms govern your access to and use of our website, mobile applications, and related services. By creating an account or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Souk Realty ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Souk Realty LLC, a company registered in the Dubai International Financial Centre (DIFC), UAE.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and Platform notifications. Your continued use of the Platform after changes are posted constitutes acceptance.

2. Eligibility & Registration

Age Requirement: You must be at least 18 years of age to use our Platform. By registering, you confirm you meet this requirement.

Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated. Providing false information may result in immediate account termination.

Account Security: You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately at security@soukrealty.com if you suspect unauthorized access.

One Account Per Person: Each individual or entity may maintain only one account. Creating duplicate accounts may result in termination of all associated accounts.

Professional Users: Real estate agents and brokers must hold a valid RERA broker registration number. We reserve the right to verify credentials and revoke access for non-compliant professionals.

3. Permitted Use of the Platform

You may use the Platform for lawful purposes only. You agree not to:

  • Post false, misleading, or fraudulent property listings
  • Impersonate any person or entity or misrepresent your affiliation
  • Use automated tools, bots, or scrapers to collect data from the Platform
  • Circumvent, disable, or interfere with security features
  • Upload malicious code, viruses, or any material that disrupts Platform functionality
  • Violate any applicable UAE law, including those related to real estate, financial services, or data protection
  • Use the Platform to facilitate money laundering or other financial crimes
  • Harass, threaten, or harm other users or our staff

We reserve the right to investigate and take appropriate legal action against any misuse, including account termination and referral to UAE authorities.

4. Property Listings

Accuracy: All property listings must be accurate, current, and comply with RERA advertising standards. Misleading descriptions, false photos, or incorrect pricing are strictly prohibited.

Ownership/Authorization: You may only list properties you own or have explicit written authorization to advertise. Listing a property without authorization is a violation of UAE real estate law.

Permit Numbers: Off-plan and rental listings must include valid permit numbers as required by RERA and the Dubai Land Department.

Removal: We reserve the right to remove any listing that violates these Terms, RERA regulations, or that we deem inappropriate. We are not obligated to provide advance notice.

Accuracy Disclaimer: While we strive to maintain listing quality, Souk Realty does not verify the accuracy of all listings. Users should conduct independent due diligence before making any property decision.

5. Property Transactions

Facilitation Only: Souk Realty is a marketplace that connects buyers, sellers, landlords, and tenants. We are not a party to any property transaction and do not act as a real estate broker unless explicitly stated.

No Guarantee: We do not guarantee the completion of any transaction or the performance of any party. All transactions are subject to the terms agreed between the parties.

Legal Compliance: All property transactions must comply with UAE real estate laws, including registration with the Dubai Land Department (DLD) and payment of applicable fees and taxes.

Dispute Resolution: Disputes between users regarding property transactions should be directed to the Rental Dispute Centre (RDC) for rental matters or the DLD for ownership disputes. Souk Realty may, at its discretion, assist in mediation but is not obligated to do so.

Due Diligence: Users are solely responsible for conducting appropriate legal and financial due diligence before entering into any property transaction.

6. Fees & Payments

Listing Fees: Certain Platform features, including premium listings, featured placements, and agent subscriptions, may require payment. Fee schedules are published on the Platform and may change with 30 days notice.

Payment Processing: Payments are processed by secure third-party payment processors. By providing payment information, you authorize the applicable charges.

Refund Policy: Subscription fees are generally non-refundable. Specific refund circumstances are governed by our Refund Policy, available upon request.

Currency: All fees are displayed and charged in UAE Dirhams (AED) unless otherwise specified.

Taxes: You are responsible for all applicable taxes related to your use of the Platform, including VAT where applicable.

7. Intellectual Property

Our Content: The Platform, including its design, text, graphics, logos, and software, is owned by Souk Realty and protected by UAE intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

Your Content: By posting listings, photos, reviews, or other content on the Platform, you grant Souk Realty a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services.

Copyright Compliance: You warrant that any content you upload does not infringe third-party intellectual property rights. Reports of copyright infringement should be directed to legal@soukrealty.com.

Trademarks: "Souk Realty" and associated logos are trademarks. Unauthorized use is prohibited.

8. Disclaimers & Limitation of Liability

"As Is" Basis: The Platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Market Information: Property prices, rental yields, and market data provided on the Platform are for informational purposes only and do not constitute financial, legal, or investment advice. Always consult licensed professionals before making property decisions.

Service Availability: We do not guarantee uninterrupted access to the Platform. Maintenance, updates, or circumstances beyond our control may cause downtime.

Limitation of Liability: To the maximum extent permitted by UAE law, Souk Realty shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, even if advised of the possibility of such damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of information as described in the Privacy Policy.

We comply with applicable UAE data protection laws, including Federal Decree-Law No. 45 of 2021 on Personal Data Protection.

10. Termination

By You: You may terminate your account at any time by contacting support@soukrealty.com. Termination does not entitle you to any refund of prepaid fees.

By Us: We may suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the Platform.

Effect of Termination: Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property rights, disclaimers, and limitation of liability.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

For disputes involving DIFC-registered entities, the parties may elect to resolve disputes through the DIFC Courts.

Nothing in this section prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.
